These Terms of Service ("Terms") govern your access to and use of the websites, platform, APIs and related services (the "Services") provided by Abigasa Advanced Technologies, LLC ("Abigasa", "we", "us" or "our"), located at 8735 Dunwoody Place, Ste N, Atlanta, GA 30350, USA.
By creating an account, accessing or using the Services, you agree to be bound by these Terms. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization, and "you" refers to that organization.
You must be at least 18 years old to use the Services. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us promptly at dev@atsadnvanced.com of any unauthorized use.
Abigasa provides a platform to create, train, deploy and monitor AI agents that perform operational tasks. We may modify, add or remove features over time. We will provide reasonable notice of material changes that adversely affect paid plans.
Paid plans are billed in advance on a monthly or annual basis. Fees are non-refundable except where required by law or expressly stated. You authorize us to charge your payment method for all applicable fees and taxes. Overdue amounts may result in suspension of the Services.
Free plans and trials are provided as-is and may be subject to usage limits. At the end of a trial, your workspace will move to the Starter plan unless you choose a paid plan.
You retain all rights to the data you submit to the Services ("Customer Data"). You grant us a limited license to host, process and transmit Customer Data solely to provide and improve the Services for you. We do not use Customer Data to train shared models. Our handling of personal information is described in our Privacy Policy.
You agree to comply with our Acceptable Use Policy. You are responsible for configuring agents, approval gates and permissions appropriately, and for reviewing agent actions where required by law or your internal policies.
We own all rights in the Services, including software, models, documentation and trademarks. Except for the limited rights granted in these Terms, no rights are transferred to you. You may not copy, modify, reverse engineer or resell the Services.
If you provide suggestions or feedback, we may use them without restriction or obligation to you.
The Services may connect to third-party products. Your use of those products is governed by their terms, and we are not responsible for their availability, security or conduct.
Each party agrees to protect the other's confidential information with at least reasonable care and to use it only to perform under these Terms.
We will provide the Services in a professional manner consistent with industry standards. Except as expressly stated, the Services are provided "as is" and we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement. AI outputs may contain errors and should be reviewed where accuracy is critical.
To the maximum extent permitted by law, neither party will be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or data. Our total liability arising from these Terms will not exceed the amounts you paid us in the twelve months before the claim.
You will defend and indemnify Abigasa against third-party claims arising from your Customer Data, your use of the Services in violation of these Terms, or your violation of applicable law.
These Terms remain in effect while you use the Services. You may cancel at any time. We may suspend or terminate access for material breach, non-payment or legal requirements. Upon termination, you may export your Customer Data for 30 days, after which it will be deleted.
These Terms are governed by the laws of the State of Georgia, USA, without regard to conflict of law principles. Disputes will be resolved exclusively in the state or federal courts located in Fulton County, Georgia.
We may update these Terms from time to time. We will post the updated version here and, for material changes, notify you by email or in the product at least 30 days in advance.
